The Act now contains a new criminal offence of “failing to consult with employees” to enable employees to contribute to the making of decisions affecting their health, safety and welfare at work. Failure to comply with the consultation provisions may result in a maximum penalty of $55,000 being imposed on a corporation for a first offence, and $82,500 for a subsequent offence.
